1. Who you are agreeing with
These terms are an agreement between you ("you") and Mircea Preotu("we", "us", "TOM"). The full operator details — including legal name and registered address as required by §5 DDG — are listed in our Impressum.
By installing or using TOM, you accept these terms. If you do not accept them, do not install or use TOM.
2. Licence — free and open source
TOM is free of charge and open source. There is no trial period, no licence fee, no subscription, and no activation server. Every feature is available to everyone, forever. The source code is published on GitHub and released under the MIT Licence.
Under the MIT Licence you are free to use, copy, modify, merge, publish, distribute, sublicense, and sell copies of the software, subject only to the condition that the copyright notice and the permission notice below are included in all copies or substantial portions of the software. The authoritative copy of the licence lives in the LICENSE file in the repository.

Third-party components bundled with or downloaded by TOM (for example the on-device AI models and their libraries) remain subject to their own licences. The MIT Licence above covers TOM's own source code.
3. Recording responsibility
TOM is a recording tool. You are solely responsible for complying with the laws and rules that apply to recording meetings in your jurisdiction and the jurisdictions of the other participants. This typically includes informing participants and obtaining consent where required.
We do not provide legal advice. We do not assume responsibility for unlawful or unauthorised recordings made with TOM.
4. AI models and offline use
TOM performs transcription, summarisation, and cross-meeting search using AI models that run locally on your Mac. On first launch, the app downloads approximately 4 GB of model weights from Hugging Face; after that, the AI features work offline and no meeting data leaves your Mac. We do not operate, proxy, or monitor any cloud AI service for TOM, and there are no usage fees of any kind.
Models, model versions, and inference behaviour may change between releases as the on-device AI ecosystem evolves.
5. Data and privacy
How we handle data on the website and in update checks is described in the Privacy Policy. The technical data flow for the app is described in the Privacy section on the homepage.
Your meeting recordings, transcripts, embeddings, and summaries are stored on your Mac. We do not receive them, and we cannot recover them if you lose them. Back up the TOM library on your Mac if it matters to you.
6. Updates and support
TOM is maintained on a best-effort basis. New releases are published on GitHub, and you are welcome to open issues or contribute there. Because TOM is provided free of charge, we make no commitment to any update cadence, response time, or continued availability. Critical security fixes may be released at our discretion.
7. Warranty disclaimer
TOM is provided "as is" and "as available", without warranty of any kind. To the maximum extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that TOM will be uninterrupted, error-free, or compatible with all hardware, macOS versions, or your specific use case.
This does not limit warranties that cannot be excluded under applicable consumer law.
8. Limitation of liability
TOM is provided free of charge. To the maximum extent permitted by law, we are not liable for any indirect, incidental, special, consequential, or punitive damages, including loss of recordings, transcripts, business, profits, data, or goodwill, even if advised of the possibility, arising out of or related to TOM.
This does not limit liability that cannot be limited under applicable law (e.g. for fraud, gross negligence, or death/personal injury caused by negligence).
9. Changes to these terms
We may update these terms. We will update the "last updated" date at the top of this page. Continued use after the update constitutes acceptance. The MIT Licence grant for any version of the source code you have already received cannot be revoked.
10. Governing law and jurisdiction
These terms are governed by the laws of the Federal Republic of Germany. Disputes will be brought before the competent courts of Düsseldorf, Germany, except where mandatory consumer-protection law in your country of residence requires otherwise.
